The below terms and conditions apply in respect of the supply of electricity to your property and the firm offer made by AusNet Services in respect of works required to connect that supply (“Firm Offer). By clicking [‘I Accept’] when prompted on the AusNet Services website, you will be agreeing to the terms and conditions specified below.
Set out below are the terms and conditions which apply in respect of an offer by AusNet Electricity Services Pty Ltd (we or us) to supply power to your property (Single Phase ;230V, up to a diversified capacity of 4kW) (Supply). To provide the Supply, we propose to install a low voltage underground service pit on the specified property boundary (AusNet Services Works).
This offer is made on the basis that the Supply capacity will not exceed 4kW (Single phase;230V). Should a Supply in excess of 4kW (Single phase;230V) be required at a future date, a further application and assessment process may be required, and additional terms and conditions will apply in respect of the works required to provide the additional supply.
The point of Supply will be the low voltage underground service pit, which will be installed at the shared property boundary and the location of the pit is at the discretion of AusNet Services.
It will be your responsibility to engage a Registered Electrical Contractor to install the necessary mains cable between that point and your installation. AusNet Services takes no responsibility for those works.
The cost you are required to pay for the AusNet Services Works is the ‘Firm Offer Amount’ specified in the website link accompanying this contract. The price displayed is excluding GST.
By clicking [‘I Accept’] and accepting these terms and conditions, you agree to pay the amount specified for the AusNet Services Works.
Subject to events beyond our control which cause AusNet Services Works to be delayed or require us to incur additional costs, we expect to be able to carry out the work required to be completed by AusNet Services approximately 4-6 weeks after the payment has been received.
IMPORTANT – TO AVOID DELAYS & CHARGES
The service pit will not be installed if property boundaries are not pegged and clearly defined. It is your responsibility to ensure that this work is done prior to the date of the AusNet Services Works. A failure to do so will delay the pit installation and additional charges may apply.
If these terms and conditions and the Firm Offer is accepted by you, AusNet Services will install a low voltage underground service pit at the shared property boundary, and the location of the pit is at the discretion of AusNet Services.
Charges will apply if any alterations or changes to the scope of works are required after your acceptance of this contract. You will be notified of those alterations or changes before additional work is undertaken.
LIABILITY
The Competition and Consumer Act 2010 (Cth) and other consumer protection laws may provide certain statutory guarantees, conditions, warranties or rights cannot be excluded or limited. Any liability we have to you under any such guarantee or term is limited to the maximum extent permitted by law, and if the law allows, is limited to:
in the case of goods, the supply of equivalent goods or paying you the cost of acquiring equivalent goods (at our option); and
in the case of services, supply the services again or paying you the cost of acquiring equivalent services (at our option).
We are not liable you in any circumstance for any indirect, special or consequential loss, damage or liability.
Sections 119 and 120 of the National Electricity Law, and any other limitations of liability or immunities granted under energy laws, are not limited in their operation or application by anything contained in this agreement
AusNet Services does not accept any responsibility for events outside our control which cause the AusNet Services Works to be delayed or require us to incur additional costs, including site conditions which may impact completion. You will be notified of any additional cost of the AusNet Services Works before additional work is undertaken.
NOTE
If applicable, a Registered Electrical Contractor may be required to install a Supply Connection Facility & Group Metering within common property in order to supply the multiple premises which share this common property. AusNet Services will request that a copy of the Certificate of Electrical Safety be provided to this office to enable a Statement of Compliance for your subdivision to be released, if applicable. These obligations are your responsibility and AusNet Services Works will be delayed if these steps are not completed beforehand.
AUTHORISATION
If you are accepting the Firm Offer on behalf of another person, or a corporation, partnership or other entity, you warrant that you have obtained all required consents and permissions required to accept these terms and conditions and have been granted full authority to enter into this letter on the relevant person’s or entity’s behalf.
You must ensure any person you are accepting this offer on behalf of understands and reads these terms and conditions in full.
FINAL CONNECTION
Prior to final connection of supply to your property you will need to have chosen and entered into an agreement with a licensed electrical retailer. Please ask your retailer about the fees associated with the connection. A list of licensed electricity retailers is available from the Essential Services Commission on 1300 134 575 or their website at www.esc.vic.gov.au
